These Terms of Use ("Terms") govern your access to and use of the website at zoinkstudio.com (the "Site") and the mobile applications published by Zoink Studio ("Zoink Studio", "we", "us" or "our") (each, an "App", and together with the Site, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be able to form a legally binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. License to Use the Apps

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and use our Apps on devices you own or control, for your own personal, non-commercial use. Apps obtained through the Apple App Store are also subject to Apple's Licensed Application End User License Agreement, which applies in addition to these Terms.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law;
• Reverse engineer, decompile or attempt to extract the source code of any App, except where permitted by law;
• Interfere with, disrupt or attempt to gain unauthorized access to the Services or their related systems;
• Copy, distribute or create derivative works of the Services except as expressly permitted.

4. Intellectual Property

The Services, including all software, design, text, graphics and the "Zoink Studio" name and logo, are owned by us or our licensors and are protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights.

5. Purchases and Subscriptions

Some Apps may offer paid features, in-app purchases or subscriptions. Payments are processed by the applicable app store (such as Apple). Prices, billing and renewal terms are presented at the point of purchase. Refunds and cancellations are handled in accordance with the policies of the app store through which you made the purchase.

6. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure.

7. Limitation of Liability

To the maximum extent permitted by law, Zoink Studio will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the relevant App in the twelve months before the claim.

8. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

9. Changes to the Services and Terms

We may modify or discontinue the Services, and we may update these Terms from time to time. When we update the Terms, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless mandatory local law provides otherwise.
