Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website at zoinkstudio.com (the "Site") and the mobile applications published by Zoink Studio ("Zoink Studio", "we", "us" or "our"), including Bezeler, Collectra and pilio (each, an "App", and together with the Site, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be able to form a legally binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. License to Use the Apps

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and use our Apps on devices you own or control, for your own personal, non-commercial use. Apps obtained through the Apple App Store are also subject to Apple's Licensed Application End User License Agreement, which applies in addition to these Terms.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law;
• Reverse engineer, decompile or attempt to extract the source code of any App, except where permitted by law;
• Interfere with, disrupt or attempt to gain unauthorized access to the Services or their related systems;
• Copy, distribute or create derivative works of the Services except as expressly permitted.

4. Intellectual Property

The Services, including all software, design, text, graphics and the "Zoink Studio" name and logo, are owned by us or our licensors and are protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights.

5. Purchases and Auto-Renewable Subscriptions

Some Apps offer optional paid subscriptions that unlock additional features: Bezeler Plus, Collectra Plus and pilio Pro, each available as a monthly or yearly auto-renewable subscription. The exact price, billing period and included features are always shown in the App at the point of purchase, before you confirm.

All payments are processed by Apple. The following terms apply to subscriptions purchased through the App Store:

• Payment will be charged to your Apple ID account at confirmation of purchase;
• The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current billing period;
• Your account will be charged for renewal within 24 hours prior to the end of the current billing period, at the price shown when you purchased (or the price you subsequently agreed to);
• You can manage and cancel your subscriptions at any time in your App Store account settings (Settings → your Apple ID → Subscriptions). Deleting an App does not cancel its subscription;
• If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription;
• Refunds are handled by Apple in accordance with App Store policies; you can request one at reportaproblem.apple.com.

If we change a subscription's price, the change applies no earlier than your next renewal, and Apple will notify you in advance as required, including, where required, asking for your consent.

6. Market Data, Estimates and Alerts

Our Apps display prices, valuations and quantity estimates, for example estimated watch values in Bezeler, card prices from marketplaces in Collectra, and material quantities and quotes in pilio. All of these are estimates provided for informational purposes only. They are derived from third-party marketplaces and databases or from AI-assisted identification, may be inaccurate, incomplete or delayed, and do not constitute a professional appraisal, financial advice, insurance valuation or engineering advice. Always verify prices, quantities and values independently before making purchase, sale or construction decisions.

Price alerts (including Grail Tracker) are delivered on a best-effort basis. We do not guarantee that an alert will be delivered, that it will be timely, or that the listed price will still be available when you act on it.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Zoink Studio will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of or related to your use of the Services, including reliance on any price, valuation or estimate shown in an App. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the relevant App in the twelve months before the claim.

9. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

10. Changes to the Services and Terms

We may modify or discontinue the Services, and we may update these Terms from time to time. When we update the Terms, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless mandatory local law provides otherwise.
